Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all users who access or use the Service, both free and paid subscribers.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.
The MAIGICIAN App Service is intended for business users only and is not designed for consumer use. By using the Service, you confirm that you are accessing and using the Service in a business capacity, and that consumer protection rights do not apply.
The MAIGICIAN App Service offers various subscription plans including, but not limited to, a free plan with limited functionality, and paid monthly or yearly plans with advanced features. The specific details of each plan can be found on our pricing page on our website.
Payments for the paid plans are processed through our third-party payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your provided payment method in accordance with the chosen plan. All payments must be made in the currency specified on the pricing page.
Paid subscription plans are billed in advance and will automatically renew on a monthly or yearly basis, depending on the chosen plan. You can cancel your subscription at any time by contacting our support team or through your account settings.
All payments are non-refundable. If you cancel your subscription, you will continue to have access to the Service until the end of the current billing period.
You are responsible for any applicable taxes, duties, or other governmental levies related to your use of the Service.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business purposes only.
You agree not to use the Service for any purpose other than as permitted by these Terms. You shall not, and shall not permit any third party to:
All intellectual property rights in and to the Service, including but not limited to copyrights, trademarks, and trade secrets, are owned by Laskowski Software sp. z o.o. and its licensors. You acknowledge that you have no rights, title, or interest in or to the Service, except as expressly provided in these Terms.
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you acknowledge and agree to the terms of our Privacy Policy.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact our support team.
In no event shall Laskowski Software sp. z o.o., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will meet your requirements, that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the Service will be accurate or reliable.
You agree to defend, indemnify and hold harmless Laskowski Software sp. z o.o. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
These Terms shall be governed and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
